1. General Terms

• These Terms of Service ("TOS") apply to all products and services provided by Explorer Canopies & Ute Trays.
• By accessing our website, placing an order, or using our installation services, you agree to be bound by these terms. If you do not agree with any part of these terms, you must refrain from using our services.

2. Products and Services

• Explorer Canopies & Ute Trays specializes in the sale, manufacturing, and installation of custom ute trays and canopies.
• All products are custom-made based on the customer's specifications. It is the responsibility of the customer to ensure that all measurements and details provided for custom orders are accurate.

3. Orders and Payment

• Orders for custom-made ute trays and canopies must be placed through our website, via email, or at our physical location.
• Full payment or a deposit (as specified at the time of purchase) is required to confirm your order. Payment can be made via cash, credit card, bank transfer, Paypal or finance.
• The final balance is due prior to the installation or shipment of the product.
• Pricing is subject to change without prior notice; however, confirmed orders will be honored at the agreed price at the time of purchase.

4. Custom Orders

• Once your custom order has been placed, you have 24 hours to make changes or cancel the order. After this period, any changes may incur additional costs.
• Cancellations after 24 hours may result in a loss of the deposit or fees to cover any costs incurred by Explorer Canopies & Ute Trays.

5. Installation Services

• Installation services are provided either at our facility or at a location agreed upon by both parties.
• Customers must ensure that their vehicle is in good condition for installation. Any issues related to the vehicle that may impact the installation process are the customer's responsibility.
• Explorer Canopies & Ute Trays will not be held liable for any damage resulting from pre-existing conditions of the vehicle or any modifications made after installation.

6. Warranty

• All ute trays and canopies come with a 2-year warranty covering manufacturing defects. This warranty does not cover normal wear and tear, accidental damage, or damage caused by improper use or installation not performed by us.
• Warranty claims must be submitted in writing to info@explorercanopies.com.au along with proof of purchase and details of the issue.

7. Intellectual Property

• All content on the Explorer Canopies & Ute Trays website, including text, images, logos, and designs, is the intellectual property of Explorer Canopies & Ute Trays unless otherwise stated.
• You may not reproduce, distribute, or otherwise use any content from our website without our prior written consent.

8. Limitation of Liability

• Explorer Canopies & Ute Trays will not be held liable for any indirect, incidental, or consequential damages resulting from the use of our products or services, including but not limited to damage to the vehicle, loss of profits, or business interruption.
• Our liability is limited to the total amount paid by the customer for the product or service in question.

9. Returns and Refunds

• Refunds are only available as per our Refund Policy. Custom orders are non-refundable unless the product is defective or does not meet the agreed specifications.

10. Force Majeure

• Explorer Canopies & Ute Trays shall not be liable for any delay or failure to fulfill its obligations under these Terms of Service resulting from causes beyond its reasonable control, including but not limited to acts of God, war, strikes, supply shortages, or governmental actions.

11. Governing Law

• These Terms of Service are governed by and construed in accordance with the laws of Australian consumer law. Any disputes arising under these terms will be resolved in the courts of NSW.

12. Changes to Terms

• We reserve the right to update or modify these Terms of Service at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued use of our services constitutes your acceptance of the updated terms.
